Privacy Policy
1. Introduction
At Rick Simpson Trading, we respect your privacy and are committed to protecting your personal data.
This Privacy Policy explains what information we collect, why we collect it, how we use and protect it, and your rights under the EU General Data Protection Regulation (GDPR).
2. What Information Do We Collect?
We collect personal data when you interact with our website, such as when you register, fill out a form, contact support, or place an order.
The categories of data we may collect include:
- Identity Data: Name, username, date of birth (if provided).
- Contact Data: Email address, phone number, billing and shipping address.
- Payment Data: Credit card or payment account details, transaction records.
- Profile Data: TradingView username, transaction history, preferences.
- Usage Data: IP address, browser type, device information, pages visited, cookies and similar technologies.
- Support Data: Emails, chat transcripts, or other communications made through our support channels.
3. Legal Basis for Processing Your Data
Under GDPR, we process your personal data based on the following legal grounds:
- Consent (Article 6(1)(a)): When you sign up for our newsletter or marketing communications, you have provided your explicit consent.
- Performance of a Contract (Article 6(1)(b)): When you purchase an indicator or request a digital service, we use your data to fulfill that contract (order processing, access provisioning).
- Legitimate Interests (Article 6(1)(f)): We may use non-sensitive usage data (e.g., analytics, logging) to improve our website, prevent fraud, and maintain security. We always balance these interests against your privacy rights.
- Legal Obligation (Article 6(1)(c)): We retain transaction records to comply with accounting and taxation laws.
4. How Do We Use Your Information?
We use the information we collect for the following purposes:
- Account Creation & Management: To register your account, verify your identity, and manage your profile.
- Order Processing & Delivery: To process purchases, issue invoices, and grant access to purchased indicators within 24 hours.
- Customer Support: To respond to inquiries, troubleshoot technical issues, and provide assistance.
- Marketing & Communication: With your consent, to send newsletters, product updates, and promotional offers. You can unsubscribe at any time by following the instructions in each email.
- Site Improvement: To analyze usage patterns to optimize our website, fix bugs, and enhance user experience.
- Legal Compliance: To maintain records for accounting, tax reporting, and any lawful requests (e.g., responding to a judicial order).
5. Definition of Access
Access to an indicator is considered provided only when our team manually provisions access to the indicator within 24 hours following confirmation of your purchase.
In accordance with European law (Article L.221-28 of the French Consumer Code), you have a 14-day right of withdrawal from the date of purchase. However, if you request—before the end of this 14-day period—that we provide you with immediate access to the indicator, you must:
- Provide your explicit consent in writing (e.g., by checking a box stating “I request immediate access and waive my right of withdrawal”).
- Acknowledge that, in this case, you irrevocably waive your right of withdrawal for this digital content.
If you do not wish to waive this right, do not request access before the end of the 14-day period.
If our team does not grant you access within 24 hours, please contact us at sales@ricksimpsontrading.com.
6. How Do We Protect Your Information?
We implement industry-standard security measures, including:
- Encryption in Transit: All data exchanged between your browser and our servers is protected by TLS/SSL.
- Secure Storage: Personal data is stored on secure servers with strict access controls and role-based permissions.
- Regular Audits: We perform periodic security audits and vulnerability scans to identify and remediate potential risks.
- Data Minimization: We collect only the data strictly necessary to fulfill the stated purposes.
7. Cookies & Tracking
To learn more about cookies and similar technologies we use, please refer to our Cookie Policy.
8. Do We Share Your Information with Third Parties?
We do not sell, trade, or rent your personal data to third parties. We share data only with trusted service providers who assist us in our operations, including:
- Payment Processors (e.g., Stripe, PayPal): To securely handle payment transactions.
- Email & Marketing Providers (e.g., Mailchimp, SendGrid): To send transactional emails (purchase confirmations, password resets) and, if you’ve opted in, newsletters and promotions.
- Hosting & Infrastructure (e.g., Amazon Web Services, Cloudflare): To store and serve our website and data.
- Analytics Services (e.g., Google Analytics): To gather anonymized usage data so we can improve the website experience. You can opt out of Google Analytics by using the Google Analytics Opt-Out Browser Add-On.
Each third party is contractually obligated to maintain the confidentiality of your data and comply with applicable privacy laws (GDPR). We may also disclose data to comply with legal obligations (e.g., court orders, subpoenas) or to protect our legal rights.
9. International Data Transfers
Some of our service providers process data outside the European Economic Area (EEA). When this occurs, we ensure that appropriate safeguards are in place, such as Standard Contractual Clauses or equivalent measures approved by the European Commission, to protect your personal data.
10. Data Retention & Your Rights
We retain your personal data only as long as necessary for the purposes described above, and as required by law. For example:
- Account Data (name, email, credentials) is retained for as long as your account is active plus 3 years after account closure.
- Transaction Records (orders, payments) are retained for 7 years to comply with French accounting and tax regulations.
- Support Logs (email threads, chat transcripts) are archived for up to 2 years, unless you request deletion earlier.
Under GDPR, you have the following rights regarding your personal data:
